A. Negative Equity is the circumstance where you find that the amount that is required to repay your mortgage on your current home is higher than the value you can gain by selling it.
Q. I am buying a new home and selling my present one in Luton. What happens to my current mortgage on completion?
A. Your current mortgage must be paid off in full on the day of completion. Your conveyancer will obtain a mortgage redemption figure pre and closer when exchange of contracts is close. The redemption sum should include any extra costs added for early redemption or similar costs.
Q. I am selling a home in Luton. I've been sent a 'Pre-Contract Enquiries' form. What is this for?

Q. I'm buying my first property and I've been advised that I should get a NHBS Certificate with it. What is this all about?
A. It's a warranty offered by the builder of the property that lasts ten years from the completion of the initial build so it's only available on new or recently constructed homes. The first 24 months will cover the buyer against any defects found to be in existence due to not complying with NHBS regulations. The builder will have to make good any major structural problems discovered during this initial guarantee 2 year period. The next 8 year period is known as the structural guarantee period and the buyer will be reimbursed for any costs of putting right any major structural defects discovered to the extent of those costs not covered by an insurance policy.
Q. I want to buy a home in Luton. I have made an offer through a property agent and it was accepted so I've requested a chartered surveyor to conduct an inspection of the property but my property agent has informed me that I have been gazumped. What does this mean?
A. This means that somebody else has made a higher offer than yours which has been accepted by the seller. It's a bad thing but not illegal, just a bit unfair. The estate agent has an obligation to pass on all offers to the owner and as long as sale contracts have not been exchanged you cannot sue for any breach as a formal contract has not been created yet.
Q. What's the difference between a licensed conveyancer and a solicitor? Are they cheaper?
A. A licenced conveyancer does not have to be a solicitor (although they might be). Some solicitors choose to operate as licenced conveyancers, rather than as a solicitor to save money on the professional insurance costs to their business. Licensed conveyancers are still members of a regulated body (http://www.conveyancers.org.uk) and are qualified to do the work of conveyancing. It is possible that a small reduction may be achieved by engaging a licenced conveyancer inpreference to a solicitor - but this isn't always the case.
