Questions & Answers

Q. I want to purchase a property in Parkstone and I need to have the conveyancing work done when I do. I've seen these services advertised on the web from £120. Do you think these rates are correct or are they excluding things like disbursements?
A. These sites are normally only displaying the "Legal Fee" which is the solicitor's professional fee for their time. Any legal fee under £125 is very suspicious. This would barely meet the time cost involved in handling your conveyancing. You are very likely to find other costs heavily inflated to make up the shortfall. E.G. you may pay over the odds for searches. It is very naughty stating a low legal fee without notifying you of all of the other charges, some of which like the land registry fee cannot be excluded.
Q. I've moved to Parkstone to be near my girlfriend. How do I go about finding a solicitor to do my conveyancing when I find the right house.?
A. You could walk up the High-Street and look for a local conveyancer; search in Google maps or find one in the Thompson Directory. However, using the w w web could be best. The internet brings two main advantages to you. (1) You will likely receive a much better quotation by shopping around and comparing quotes. (2) You can read reviews to establish who is going to do the best job for you. It is the balance between price and quality that should select.
Q. Please explain the difference between the legal fee and a disbursement?
A. The legal fee is the professional fee that the conveyancing solicitor charges for their time and experience. Disbursements are all of the other sundry costs - many of of which are unavoidable - these include the land registry charge and SDLY stamp duty land tax. Disbursements may perhaps include items such as identity confirmation, form completion charges and search charges and bank charges for the transfer of money.
Q. I am buying a new house and selling my present one in Parkstone. What happens to my present mortgage on completion?
A. Your present mortgage must be paid off in full on the day of completion. Your legal adviser will obtain a mortgage redemption figure before and closer when exchange of contracts is happening. The redemption amount should include any extra charges added for early redemption or similar charges.
Q. I'm buying my first property and I've been advised that I should get a NHBS Warranty with it. What does this mean?
A. It's a warranty offered by the builder of the property that lasts ten years from the completion of the initial build so it's only available on new or recently constructed homes. The first 2 years will cover the buyer against any defects found to be in existence due to non-compliance with NHBS regulations. The builder will have to make good any major structural problems discovered during this initial guarantee 2 year period. The next 8 year period is known as the structural guarantee period and the buyer will be reimbursed for any costs of putting right any major structural problems discovered to the extent of those costs not covered by an insurance policy.
Q. What is the difference between a Leasehold and a Freehold property?
A. Generally, if you own the freehold of a property then you are the undisputed owner of it for no fixed period of time and subject to any statutory or other regulatory interests you can do what you like with it. If a property is Leasehold then the freehold is owned by someone else like a land agent for instance who will grant a lease to you allowing you to use the land or property for a long period of time. Usage restrictions and obligations will be written into the lease terms.
Q. I'm making an offer for a house in Parkstone . How long does it take to complete the legal work once I've appointed a solicitor?
A. It usually depends on how quick both party's solicitors can work. You may have a excellent and efficient conveyancer but if the other party have a rubbish solicitor the work may drag on. An ideal situation where both solicitors are good should result in your case being completed within 40 days.
Q. There may be a future Greenfield development project occurring in Parkstone. What is a Greenfield site?
A. The term Greenfield as applied to land or a site describes undeveloped land in a town which might be land that has been utilised for farming or it could just be country land. This could be an existing open field, or a place which is normally closed to the public. Generally it can be determined that a Greenfield site is the opposite to a Brownfield site.
Q. I am buying my first house in Parkstone and I will be having a mortgage from Santander. Can your solicitors work with these lenders?
A. Yes our panel members are authorised to work with that lender.
Q. My licensed conveyancer said I need searches. What is the purpose of the searches ?
A. Searches are a very important element of conveyancing on a Parkstone property purchase. Searches do all of the researching into the property, so that you know in detail what you are purchasing. Are there any environmental snags? Are there trees under protection? Are there covenants on the land or house? Are there mine-workings in the area of it? Are you responsible for giving towards to the maintenance of the parish church? Has formal planning permission been granted for any alterations done on the property? This is to name but a few. A little spent on searches before purchase can save a lot of heartache, and could save you from purchasing a house that you will later regret.

We have been very happy with Kayleigh Needham and her colleague Chloe who was always very helpful in answering enquiries by telephone. I have used Chadwick Lawrence in a previous purchase as well as this one and would not hesitate to use their services again.

The email updates sent by Joseph Hyndman were very helpful. They helped me see when each stage of the process had been completed. He was also very calm when the exchange process had to be halted part way through, as one of the chain couldn't complete on the expected date after all. I know that some solicitors still just use letters to update clients - which is way too slow - so email updates were great.
