Q. I live in Blackpool. If I decide not to use a local conveyancing solicitor to help sell my home and use an Internet conveyancer instead, are there any snags I should watch out for?
A. You should always check whether the solicitor is properly listed with the Law Society. It is also important that you obtain any reviews you can find on the conveyancer to be sure that you are going with a practice with a good reputation. Working at a distance should not be a problem. It is also good practice to check that your chosen firm has a decent case tracking system which you can log into to keep an eye on the progress of your case.
Q. My Blackpool, solicitor is not providing a 'no-complete no fee' product. Should I insist on this as I know that some cases fail to complete.
A. Many solicitors offer a no-complete no fee option (so you will at the very least get this back) so it is a good product. You could additionally think about speaking to your insurance broker or IFA about taking out a small insurance product that would provide protection for all of your investment should your transaction fail.
Q. Do I need the conveyancer to do a Chancel Search?
A. There could, perhaps be a Chancel repair liability - which is a legal requirement for a number of home owners in Blackpool to contribute towards the maintenance of the Blackpool parish church. Your legal adviser will inform you if you are advised to have a Chancel search.
Q. My conveyancing solicitor is offering a 'no win - no fee 'option. Does this mean that I'll get all my money back if the sale fails?

Any fees spent on other costs will not normally likely be refunded to you. Q. I've received and accepted an offer on my home. My buyer is awaiting a mortgage offer before they can proceed. What does this mean?
A. Ideally your purchaser should have agreed a mortgage in principle from a lender before they'd started looking for a house. This would have confirmed how much money they can get to fund their purchase. The application process would immediately assess whether the lender can provide the money based upon the criteria they prescribe and an 'Offer in Principle' in the form of a letter is normally issued. Sometimes monies may not be made available even though the lending criteria has been met because the lenders funds for the period may have been exhausted.
Q. Do I have to pay Capital Gains tax if I sell my house?
A. It depends on your tax status and other factors but generally, if the house in question has been lived in by you as your main residence during the period of ownership, then no CGT is payable.
Q. They are building some new housing on a Brownfield site in Blackpool. Can you explain what a Brownfield site is?
A. Brownfield normally describes derelict land which has usually been prior used for industrial use. These sites are particularly located in rural areas. Often, the land is contaminated so will have to be treated before it can be used for residential purposes again. Usually traces of contaminants such as tribultyltins can usually be found on these sites.
